NOTICE OF A PUBLIC MEETING CONCERNING A PROPOSED AMENDMENT TO THE
(FORMER VILLAGE OF WINCHESTER) ZONING BY-LAW OF THE CORPORATION OF THE TOWNSHIP OF NORTH DUNDAS
TAKE NOTICE that the Council of The Corporation of the Township of North Dundas will hold a public meeting on the 8th day of November 2022 at 6:30 p.m. at the North Dundas Municipal Council Chambers 636 St. Lawrence Street, Winchester, Ontario to consider a proposed amendment to (Former Village of Winchester) Zoning By-law No. 25-96 under Section 34 of the Planning Act, R.S.O. 1990, Chapter P. 13, as amended.
THE PROPOSED ZONING BY-LAW AMENDMENT would change the zoning of the lands known as being Part of Lot 28 South of Main on Plan 34 former Village of Winchester, now the Township of North Dundas, County of Dundas. Municipally known as 486 Victoria Street Winchester, as indicated by the blue outlined area on the attached Key Map. The purpose is to rezone the property from Residential Type 2 Zone (R2) to Residential Type 4 Zone Exception 10 holding (R4-10h).
IF THE PROPOSED BY-LAW is adopted, the subject property will be permitted to construct the two additional units in an existing six unit converted dwelling. Increasing the number of units to eight units- changing the existing 6 plex into an apartment dwelling house, permitted under Residential Type 4 Zone (R4). The exception zone will permit a reduction in front yard setback from 6 metres to 4 metres, and increase in permitted density from 7.28 units to 8 units, relief from the requirement to have a privacy yard or an equipped children’s play area, a reduction in aisle width for parking from 6 m to 5.5 metres and relief from parking space proximity to property lines from 1.5 m to 0.5 m. The holding provision will have to be lifted before any construction can proceed. The holding being lifted is contingent on sufficient water and wastewater services being available to service the additional two units, and site plan approval.
IF A PERSON or public body would otherwise have an ability to appeal the decision of the Council of The Corporation of the Township of North Dundas to the Ontario Land Tribunal (the Tribunal) but the person or public body does not make oral submissions at a public meeting or make written submissions to the Township of North Dundas before the By-law is passed, the person or public body is not entitled to appeal the decision.
IF A PERSON or public body does not make oral submissions at a public meeting or make written submissions to the Township of North Dundas before the By-law is passed, the person or public body may not be added as a party to the hearing of an appeal before the Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to do so.
